Terms & Conditions

These Terms & Conditions ("Terms") govern your use of the Body by Dolo website, coaching services, classes, memberships, gift cards, and related products (collectively, the "Service") provided by Body by Dolo ("we", "us", "our"). By using the Service you agree to these Terms.

1. Who You Are Contracting With

The Service is provided by Body by Dolo. Your contract for the Service is with Body by Dolo. Payment, billing, tax, cancellation, and refund handling are processed by our online reseller Paddle.com, which acts as Merchant of Record.

2. Acceptance

By continuing to use the Service, or by purchasing coaching, classes, memberships, or gift cards, you agree to be bound by these Terms. If you do not agree, do not use the Service.

3. Eligibility & Health Acknowledgment

You must be at least 18 years old, or have consent from a parent or guardian, to purchase or use the Service. Physical training carries inherent risk. You represent that you are physically able to participate and agree to consult a qualified medical professional before starting any program. You assume all risk of injury.

4. Acceptable Use

You agree not to:

• use the Service unlawfully or for fraud, spam, or harassment;
• infringe our or a third party's intellectual property;
• interfere with the Service's security, including probing, scraping, or introducing malware;
• resell, redistribute, or share your access with others.

5. Intellectual Property

All content, programming, branding, video, written material, and software associated with Body by Dolo is owned by Body by Dolo and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable right to access purchased content for personal, non-commercial use.

6. Payment, Subscriptions & Billing

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, subscription renewal, billing frequency, taxes, and cancellation mechanics are governed by the Paddle Buyer Terms.

8. Gift Cards

Gift cards are non-refundable once issued but may be redeemed toward any eligible service. Gift cards may not be exchanged for cash except where required by law.

9. Availability & Service Level

We do not guarantee that the Service will be uninterrupted or error-free. We may modify, suspend, or discontinue any part of the Service at any time.

10. Suspension & Termination

We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations.

11. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" without warranties of any kind. Results from fitness programs vary from person to person and are not guaranteed.

12. Limitation of Liability

To the fullest extent permitted by law, Body by Dolo's aggregate liability arising out of or relating to the Service is limited to the amounts you paid to us in the twelve (12) months preceding the claim. We are not liable for indirect, incidental, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by negligence where such exclusion is prohibited by law.

13. Indemnity

You agree to indemnify and hold Body by Dolo harmless from claims arising out of your misuse of the Service or violation of these Terms.

14. Governing Law

These Terms are governed by the laws of the State of Kansas, USA, without regard to conflicts of law principles.

15. Changes

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
